Terms and Conditions for UGaming Subscription Service
1. Service Provider
The UGaming service is provided by Umniah Mobile Company ("We", "Us", or "Our") to eligible customer under the terms outlined in these Terms and Conditions, the General Conditions of Service, your Application, and any additional applicable terms and conditions posted on your dashboard or our designated platforms (collectively, the "Contract").
2. Eligibility
2.1 The Service is exclusively available to customers of Umniah’s Fiber-to-the-Home broadband service who subscribe to the U-Gaming Service.
2.2 The U-Gaming Service is available with all U-Gaming Packages and includes guaranteed latency performance levels (the “Latency Guarantee”) as outlined on the customer`s Gaming dashboard.
3. Money-Back Guarantee
3.1 The Money-Back Guarantee applies solely to round-trip latency measurements to designated game servers as monitored through the dashboard provided with the Service. Latency measurements are done through Umniah’s platform and viewed to the Customer through their dedicated Gaming dashboard.
3.2 The Latency Guarantee covers latency performance to specified regions and overseas game servers for games that are included only in our dashboard and in accordance to the latency performance that shall appear in our dashboard and it might be changed from time to time.
3.3 The Customer acknowledges and agrees that the latency guarantee will only cover the games that are hosted in any of the following Regions (ME Dubai, ME Bahrain and Europe ,).If the game provider decided to remove their game’s hosting from these servers, then, we are not liable to the aforementioned latency performance in our dashboard.
3.4 A claim under the Money-Back Guarantee must meet the following requirements:
A. The Gaming dashboard must show that the captured round-trip latency to any designated game server exceeded the Guaranteed Latency threshold for at least 2 consecutive hours. A claim button will only become visible on the dashboard once these requirements are met. A claim can only be submitted via the Gaming dashboard.
B. Latency is defined as the round-trip time between the Fiber Router (ONU) and the gaming server. Customer can get the best latency results if the gaming console is connected via ethernet cable (Cat 6) to the gaming router or ONU.
3.5 Claims are subject to the following limitations: (a) Only one claim may be submitted within a 30 days period (b) Claims must be submitted via the dashboard within 24 hours of the latency measurement. (c) Claims will be processed instantaneously. (D)Additional supporting documents are not normally required but maybe requested.
3.6 for all valid claims, the refund will be limited to the Gaming Service fees each month, which equals an amount of Five Jordanian Dinar per month. The refund will be issued as a credit on the Customer’s next bill.
3.7 The Money-Back Guarantee does not apply in the following circumstances: (a) Latency issues caused by outages, congestion, or other incidents on designated game servers or third-party networks outside our control. (b) Outages or incidents resulting from force majeure events, third-party negligence, or malfeasance. (c) Accessibility issues caused by the game provider’s IP address being blocked by third parties. (d) Performance issues related to non-designated game servers.
4. Customer Obligations
Customers are responsible for: (a) Ensuring the proper setup and maintenance of their equipment, including the use of suitable Ethernet cables and adherence to guidelines provided by us. (b) Conducting latency measurements according to the requirements specified in these Terms and Conditions.
5. Data Usage and Privacy
Data collected during latency monitoring will be handled in accordance with applicable privacy laws and our Privacy Policy.
6. Termination
a) The U-Gaming Service is provided as hard bundled. This means that if the Customer wishes to terminate the U-Gaming Service before the expiry date of the Customer`s commitment, then the early termination fees may apply, which include the monthly charges for the remaining duration of the bundled service term as outlined in the Application, along with any additional fees related to the terminated package of the U-Gaming Service.
b) All devices provided as part of the package are rented and must be returned upon service termination. If the devices are not returned, The Customer will be required to pay the full cost of the devices.
7. Liability and Indemnification
7.1 We are not liable for latency issues or outages caused by third-party servers, networks, or unforeseeable events beyond our control.
7.2 Customer agrees to indemnify and hold us harmless against any claims arising from improper use of the Service or violations of these Terms and Conditions.
8. General
8.1 We reserve the right to amend these Terms and Conditions or any part of the Contract unilaterally. Updates will be published on our eShop or other designated platforms. Continued use of the Service constitutes acceptance of the updated terms.
8.2 These Terms and Conditions are governed by and construed in accordance with the laws of the Hashemite Kingdom of Jordan.
8.3 All interpretations and decisions regarding these Terms and Conditions and related provisions shall be at our sole discretion and are final, binding, and conclusive.
8.4 In the event of any discrepancy between the English version and any translated version of these Terms and Conditions, the English version shall prevail.
9. Dispute Resolution
Any disputes arising from or related to these Terms and Conditions shall be resolved under the applicable laws of the Hashemite Kingdom of Jordan.
